Terms of Service

1. What the Service does

The Service is software for taxi and transfer companies: recording trips, assigning them to drivers, tracking their status, issuing invoices and settling payouts.

We provide the software. We do not carry passengers, we are not a party to your transport contracts, and we do not act as an intermediary between you and your customers. Responsibility for the transport, for licences, insurance and for compliance with transport law rests with you.

2. Account and company

To use the Service you register a company account. The person who registers acts as the owner and may invite further users and assign their roles.

You are responsible for everything that happens under your account, for keeping passwords confidential, and for making sure that the people you invite are allowed to see the data they are given access to.

Each company sees only its own data. We do not merge data between companies.

3. Drivers

Drivers receive access through an invitation from the company. A driver sees the trips assigned to them, their own earnings and their own expenses.

Location is transmitted only during a running trip and only while the driver has switched it on. The driver can stop it at any time, and the app shows plainly when it is running.

4. Subscription and payment

New companies start with a free trial period. After it ends, continued use requires a paid plan. Prices and the included number of drivers are shown in the application.

Subscriptions renew for the same period unless cancelled before the end of the current period. Payments already made for a running period are not refunded on cancellation, except where the law requires it.

We may change prices with at least 30 days notice before the start of the next period. If you do not accept the change, you may cancel with effect from that date.

5. Your data

The data you enter remains yours. We process it to operate the Service, and as described in the Privacy Policy.

You can export your data at any time while the account is active. After the account ends we delete the data within 90 days, unless the law requires us to keep it longer.

6. Availability

We work to keep the Service available, but we do not promise uninterrupted operation. Maintenance, faults at our hosting providers or circumstances beyond our control may interrupt it.

The Service is a record-keeping and dispatch tool, not a safety system. Do not rely on it for anything where a failure would put a person at risk.

7. Estimates and calculations

Distances recorded from GPS, and any figures derived from them, are approximations. They are informative and do not replace your own bookkeeping.

Invoices, payout shares and settlements are produced from the data you enter. Check them before sending them out or paying on them.

8. Liability

We are liable for damage caused intentionally or through gross negligence, and for injury to life, body or health, without limitation.

Otherwise our liability is limited to the fees you paid for the Service in the twelve months before the event. We are not liable for lost profit, lost data where you could reasonably have kept a copy, or indirect damage.

9. Termination

You may cancel at any time with effect from the end of the current billing period.

We may suspend or terminate an account that does not pay, that uses the Service unlawfully, or that endangers the operation of the Service for others. Where possible we give notice first.

10. Changes to these terms

We may change these terms. We announce changes in the application at least 30 days before they take effect, and ask you to accept them again. If you do not accept, you may cancel with effect from that date.

11. Governing law and place of jurisdiction

Swiss law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is the registered office of Skilliyo in Switzerland, unless a mandatory place of jurisdiction provides otherwise.
